Intellectual Property, Trademark, & Right of Publicity Policy
To protect our customers, our business, and the creative work of artists worldwide, Fig Tree Works strictly complies with all federal, state, and international laws regarding Copyright, Trademark, and the Right of Publicity.
By submitting any image, graphic, logo, or design (collectively, “Content”) to Fig Tree Works for printing or manufacturing, you (the “Customer”) agree to the following terms:
1. Ownership and Copyright Warranties
- Customer Warranty: The Customer warrants and represents that they are the sole owner of the copyright for the submitted Content, or that they have obtained explicit, written, and lawful permission from the legal copyright holder to reproduce the image.
- Prohibited Content: We will not print images, illustrations, or graphics taken from the internet, social media, search engines, or television broadcasts without verifiable proof of a license or permission from the original creator.
2. Trademark and Logo Restrictions
- Corporate Brand Restrictions: We will not print corporate logos, brand names, sports team insignias, or trademarked catchphrases (e.g., Nike, Disney, NFL, band logos) unless the Customer provides official corporate authorization or licensing documentation.
3. Right of Publicity & Celebrity Likeness
- The Rule: The “Right of Publicity” protects an individual’s right to control the commercial use of their name, image, likeness, voice, or persona.
- Public Figures: Fig Tree Works strictly prohibits the printing of merchandise featuring recognizable celebrities, musicians, professional athletes, politicians, or public figures.
- Photographer Ownership Exception: Even if the Customer physically photographed the celebrity themselves (e.g., at a concert, sporting event, or political rally), owning the photograph’s copyright does not grant the right to use that individual’s face on manufactured merchandise for commercial transactions.
- Mandatory Refusal: We reserve the right to immediately cancel and refund any order featuring an unauthorized public figure’s likeness.
4. Indemnification and Liability
By submitting an order, the Customer agrees to defend, indemnify, and hold harmless Fig Tree Works, its owners, and its employees from and against any and all claims, damages, costs, and expenses (including attorneys’ fees) arising from or related to any copyright, trademark, or right of publicity infringement claims brought by third parties regarding the printed Content.
5. Right of Refusal
Fig Tree Works reserves the absolute right to refuse to print any submission that we believe, in our sole discretion, may violate intellectual property laws, regardless of any waivers signed by the customer.
